Lawyer v Equifax Inc. - Class action against Equifax over data breach filed in Houston 9/19/2017

Class action suit against Equifax Inc. over massive hack of credit report data filed in state district court in Houston yesterday, Sep. 19, 2017. 


The verified (sworn-to) class action petition was filed on behalf of a plaintiff with last name Lawyer, and was randomly assigned to the 269th District Court, Harris County, Texas. The case style will be memorable. 

The scope of the freshly-filed civil action is not entirely clear, however. The pleading invokes the Texas class action rule and states that it is being brought on behalf of affected Texas "citizens" only, according to one section of the complaint, but nevertheless explains in the FACTUAL ALLEGATION section that it is being brought on behalf of 140 million consumers across the country.

The original petition (not labelled "complaint" as in federal court) alleges that all of the negligent acts of and by the Defendant (subsidiaries are also mentioned) occurred in Texas, and that venue is proper in Harris County because Equifax, though a Georgia corporation, has its principal office in Houston. The named plaintiff and proposed class representative, Joan Lawyer, is described as an individual consumer residing in Forney, Kaufman County, Texas.
